These Terms govern your use of AutoLab AI and its AI-generated vehicle visualization service.

Important: AI results are creative concepts, not engineering or safety advice. Confirm any real-world vehicle modification with qualified professionals and applicable law.

1. Acceptance and eligibilityThese Terms & Conditions ("Terms") form an agreement between you and Hopefy Tech ("Hopefy," "AutoLab AI," "we," "us," or "our"). They govern your download, access, purchase, and use of AutoLab AI and related services.
By completing onboarding, submitting content for AI processing, purchasing a subscription, or otherwise using AutoLab AI, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
AutoLab AI has a 4+ App Store content rating and is suitable for a general audience. If a user is not legally able to accept these Terms or consent to data processing in their country, a parent or legal guardian must review and accept these Terms on the user's behalf, authorize the user's AI photo processing, supervise use of the service, and approve any purchase. If you allow a child to use AutoLab AI, you are responsible for that child's use. If you use AutoLab AI for an organization, you represent that you have authority to bind it.

2. The serviceAutoLab AI uses third-party artificial intelligence to transform a vehicle photograph according to presets and optional instructions you choose. Features may include Paint, Wrap, Wheels, Body Kit, Spoiler, LED, Tint, Carbon, Interior, before-and-after comparison, local Garage storage, sharing, and subscription access.
AutoLab AI may provide one eligible free Paint generation. Premium features and available subscription plans are shown in the app. A network connection and a supported iOS device are required for cloud generation, subscription verification, restore, and server-side data deletion.
The service is a visualization and creative-entertainment tool. It does not inspect a physical vehicle and does not determine whether a modification is compatible, road legal, structurally safe, insurable, manufacturable, or available for purchase.
3. Your photos and instructionsYou retain the rights you hold in photographs, instructions, and other content you submit ("Input"). You grant Hopefy and its service providers a limited, worldwide, non-exclusive license to host, reproduce, transmit, process, and format Input only as reasonably necessary to provide, secure, recover, and maintain the requested service, comply with law, and enforce these Terms.
You represent and warrant that:● you own the Input or have all permissions necessary to submit and process it;● the Input and your requested use do not violate intellectual-property, privacy, publicity, confidentiality, contractual, or other rights;● you have appropriate permission for identifiable people, private property, license plates, or confidential information appearing in the Input; and● your Input and instructions comply with these Terms and applicable law.Do not upload sensitive personal information that is unnecessary for a vehicle visualization. Details about processing and deletion are provided in the Privacy Policy.
4. AI-generated outputsImages produced by AutoLab AI ("Output") are generated probabilistically. Output may fail to follow an instruction, differ from reference previews, modify unintended details, contain visual artifacts, resemble other outputs, or be inaccurate, incomplete, offensive, or physically impossible. We do not guarantee uniqueness, originality, non-infringement, or suitability for any purpose.
As between you and Hopefy, and to the extent permitted by applicable law, you retain your rights in the Input and may use the Output for lawful personal or commercial purposes. To the extent Hopefy acquires any rights in an Output created specifically for you, Hopefy assigns those rights to you. This does not transfer rights owned by third parties, and you are responsible for obtaining any permissions required for your use.
Vehicle names, logos, body designs, characters, artwork, locations, and other elements may be protected by third-party rights. AutoLab AI does not grant a license to those elements. Outputs are non-exclusive, and other users may receive similar results.
You must not present an Output as an actual installed modification, inspection, valuation, accident record, engineering plan, or authenticated photograph where doing so could mislead someone.
5. Acceptable useYou may not use AutoLab AI, Input, or Output to:
● violate law, sanctions, export controls, or third-party rights;● upload content without required ownership, authorization, consent, or lawful basis;● create or distribute sexual exploitation material, content involving sexualized minors, or content that endangers a child;● promote targeted hatred, extremist activity, credible threats, unlawful violence, harassment, or abuse;● commit fraud, impersonate another person, fabricate evidence, deceive consumers, or invade privacy;● distribute malware, probe vulnerabilities, reverse engineer protected service components, or disrupt infrastructure;● bypass subscriptions, authentication, App Check, rate limits, concurrency controls, safety controls, or access restrictions;● use automated or excessive request volumes that degrade the service or impose disproportionate cost; or● resell access to the service or use it to build a competing service without written permission.We may reject a request or restrict access when reasonably necessary for safety, security, legal compliance, service integrity, or enforcement of these Terms. 6. Subscriptions, renewals, and refundsPlans and benefitsAutoLab Premium may be offered as weekly and annual auto-renewable subscriptions. The app displays the available plan, billing period, localized price, and included features before purchase. Premium is intended to provide ongoing generation access without a consumable credit balance; reasonable concurrency, cooldown, fair-use, safety, security, and technical controls still apply. No service can guarantee uninterrupted or instantaneous generation.
Payment and renewalPayment is charged to your Apple ID when you confirm the purchase. A subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Apple may charge the renewal within 24 hours before the current period ends. Prices may vary by storefront, tax, currency, and future plan changes presented by Apple.
Manage, cancel, and restoreYou can manage or cancel through Apple's subscription settings at apps.apple.com/account/subscriptions. Cancellation generally takes effect at the end of the paid period; deleting the app or using Delete my data does not cancel Apple billing. Restore Purchases can re-link an eligible App Store entitlement to the current anonymous AutoLab AI identifier.
Free trials and promotionsIf Apple displays a trial, introductory price, or promotional offer, its duration, eligibility, conversion price, and renewal terms are shown before confirmation. Unless canceled before the displayed deadline, the offer may convert to a paid subscription.
RefundsApple processes App Store payments and refund requests. You may request a refund at reportaproblem.apple.com. Eligibility is determined by Apple and applicable law. Nothing in these Terms limits non-waivable statutory cancellation or refund rights.
7. Availability and changesGeneration depends on network connectivity and third-party systems, including Apple, Google Firebase, OpenAI, and RevenueCat. We may add, modify, limit, suspend, or discontinue features, models, presets, quality levels, or service capacity to improve the product, maintain security, manage dependencies or cost, respond to abuse, or comply with law.
We will not intentionally deprive you of a paid benefit without regard to applicable law, but we do not guarantee that every feature, model, or visual style will remain available indefinitely. Scheduled maintenance, outages, model safety refusals, capacity constraints, or provider changes may delay or prevent a generation.
8. AutoLab AI intellectual propertyAutoLab AI, including its software, interface, brand, layout, presets, graphics, non-user content, and service technology, is owned by Hopefy or its licensors and protected by intellectual-property law. Subject to these Terms and Apple's usage rules, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the app on Apple-branded devices that you own or control.
You may not copy, sell, sublicense, distribute, rent, lease, publicly host, or create derivative works from protected AutoLab AI software or service content except where applicable law expressly permits.
9. Third-party services and brandsAutoLab AI uses Apple, Google Firebase, OpenAI, and RevenueCat. Their terms and privacy policies may apply to their respective services. We are not responsible for third-party websites or destinations you choose through the iOS Share Sheet.
AutoLab AI is an independent visualization tool and is not sponsored, endorsed, or affiliated with any vehicle manufacturer, aftermarket brand, artist, or character owner. Names, marks, vehicle designs, and other third-party content belong to their respective owners.
10. Suspension and terminationYou may stop using AutoLab AI at any time and may request deletion through Settings. We may suspend, restrict, or terminate access for material breach, fraud, abusive activity, safety risk, legal requirement, or conduct that threatens users or the service. Where appropriate and legally required, we will provide notice and an opportunity to appeal by contacting support.
Termination ends your license to use the service but does not automatically cancel an App Store subscription. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—will survive.
11. DisclaimersTo the maximum extent permitted by law, AutoLab AI is provided "as is" and "as available." We disclaim express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.
We do not warrant that the service will be uninterrupted, secure, error-free, or compatible with every photo or vehicle; that an Output will match a prompt or preview; or that defects will be corrected. Outputs are not professional automotive, engineering, mechanical, safety, legal, insurance, valuation, or regulatory advice.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted, and mandatory consumer guarantees remain unaffected.
12. Limitation of liabilityTo the maximum extent permitted by law, Hopefy and its officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, opportunity, goodwill, or data; vehicle damage; personal injury arising from real-world implementation; or decisions made using an Output.
To the maximum extent permitted by law, our aggregate liability arising from AutoLab AI will not exceed the greater of (a) the amount you paid for AutoLab AI during the 12 months before the event giving rise to the claim or (b) USD $50. This limit does not apply where liability cannot legally be limited, including certain liability for fraud, willful misconduct, death, or personal injury.
You agree to defend and indemnify Hopefy against third-party claims arising from your Input, your unlawful or infringing use, your breach of these Terms, or your real-world implementation of a generated concept, except to the extent prohibited by applicable consumer law.
13. Apple-specific termsThese Terms are between you and Hopefy, not Apple. Apple is not responsible for AutoLab AI or its content. Your use must comply with the Apple Media Services Terms and applicable App Store Usage Rules. The license is limited to use on Apple-branded products you own or control, including other accounts associated through Family Sharing or volume purchasing where permitted.
● Hopefy, not Apple, is responsible for maintenance and support, except as otherwise required by law.● If AutoLab AI fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the app purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.● Hopefy, not Apple, is responsible for product claims, legal compliance, consumer-protection claims, and claims that the app infringes third-party intellectual-property rights.● You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country and are not listed on a U.S. Government prohibited or restricted party list.● Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.These product-specific Terms supplement the Apple Standard End User License Agreement. Mandatory Apple terms and applicable law control where they cannot be varied.
14. Governing law and disputesThese Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Subject to non-waivable consumer rights, courts located in New York State will have jurisdiction over disputes. If the law where you live gives you mandatory rights or permits you to bring a claim in your local courts, those rights are not excluded.
Before filing a claim, please contact hcet.yfepoh%40troppus and provide a brief description so we can attempt to resolve the issue informally.
If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, acquisition, or transfer of the service.
15. Changes to these TermsWe may update these Terms to reflect product, provider, legal, security, or business changes. We will update the effective date and provide additional notice where required. If a material change requires consent, we will request it. If you do not agree to revised Terms, stop using the service and cancel any subscription before its next renewal.
